§ 00

About these terms

Welcome. These Guest Terms of Use ("Terms") cover your use of the Geocast guest experience: the stories, narrations, hidden cards, maps, and other content you discover when you scan a QR code at a property, tap a deep link, open the Geocast app, or otherwise engage with a Geocast-powered property as a visitor.

If you operate a property using Geocast (a hotel, museum, winery, or similar business), a separate Operator Terms of Service applies to you, available at geocast.ai/legal/operator-terms.

By using the Geocast guest experience, you agree to these Terms. If you do not agree, do not use the experience.

These Terms are short on purpose. Geocast is a story layer, not a destination you visit. We want you to spend your time at the property, not reading legal text. But we still need to cover a few things.

§ 01

Who can use the experience

You can use the Geocast guest experience if you are at least 13 years old. If you are between 13 and 18, please use the experience with the awareness of a parent or legal guardian.

If you are under 13, you may use the experience only when supervised by a parent or legal guardian who has agreed to these Terms on your behalf. The kids' guides and family content available at some properties are designed for supervised use.

Additional protections for minors based on where you live

Some jurisdictions provide additional protections for minors that go beyond the general age rules above. Geocast honors these protections automatically when applicable:

  • California (CPRA). If you are a California resident between 13 and 16, Geocast obtains your opt-in consent before selling or sharing your personal information. Geocast does not sell or share personal information for cross-context behavioral advertising, so this protection is largely confirmatory; we mention it because California law specifically requires the disclosure. For California residents under 13, verifiable parental consent is required before any personal information is collected.
  • Other US states with comprehensive privacy laws. Connecticut, Colorado, Florida, Oregon, and other states have age-specific protections for minors (typically opt-in for 13 to 15 or 13 to 16, parental consent for under 13). Geocast honors the strictest applicable protection in your state.
  • European Economic Area, United Kingdom, and Switzerland. If you are an EEA, UK, or Swiss resident under 16, additional parental consent applies to any data processing beyond what is strictly necessary to deliver the experience, in accordance with GDPR Article 8 and equivalent rules.
  • Other jurisdictions. Where local law provides specific protections for minors that are stricter than the rules above, Geocast honors those local protections.

These protections apply automatically based on your jurisdiction; you do not need to invoke them.

§ 02

What Geocast is and is not

Geocast is a content layer that lets properties tell their own stories to their guests. When you scan a QR code at a property and start a story, that story comes from a property using Geocast, not from a hotel chain, an OTA, or any third party trying to sell you something.

Geocast may send you push notifications related to the property's experience. These can include story arrivals when you are near a Castpoint, Hidden Card reveals, Today Feed updates, weather and condition overrides relevant to the property, and similar one-way messages from the property. You can disable push notifications at any time. In the mobile web experience, web push notifications are controlled through your mobile browser's site permissions or your device's operating system notification settings; the path varies by browser (Safari, Chrome, Firefox) and platform (iOS, Android). In the native Geocast app, you can disable notifications either through the app's privacy controls or through your device's operating system notification settings for the Geocast app. Disabling notifications at the OS level overrides any in-app or in-browser preference.

Push notifications are one-way. Geocast is not a way for you to message the property, and the property cannot use Geocast to have a conversation with you.

Geocast is not:

  • A two-way messaging or concierge service. To make a request, ask a question of property staff, or place an order, contact the property directly through the channels they provide.
  • A booking system or reservation tool
  • A payment processor
  • An advertising platform
  • A safety or emergency communications system. Time-sensitive notifications (such as storm advisories at the property) are best-effort information from the property, not a substitute for emergency services. In an emergency, contact local emergency services or the property's front desk directly.

If you have a question about your stay, a request, or an emergency, contact the property directly. Geocast does not pass messages to property staff, place orders, or handle on-site service requests.

§ 03

Your license to use Geocast content

Stories, narrations, hidden cards, imagery, and other content you experience through Geocast are owned by Geocast and the property operator. We grant you a personal, non-transferable license to listen to, read, and experience that content as a guest.

What you can do

You may:

  • Listen to and read content while you are at or near the property
  • Take screenshots of cards, scenes, or moments for personal use
  • Share screenshots, mentions, and brief quotes on your personal social media
  • Discuss content in conversation, write about it in personal writing or reviews, and reference it casually as you would any travel experience
  • Use content for educational or journalistic purposes consistent with applicable fair-use law

What you cannot do

You may not:

  • Bulk download, scrape, or systematically copy stories, audio, hidden card content, or other Geocast content
  • Republish content commercially, on any platform, in any medium
  • Use content to train AI models, build derivative products, or compete with Geocast or with the property
  • Remove or alter source attribution, credits, watermarks, or other identifying information
  • Reverse engineer the app, the beacon system, the structured data layer, or any part of the Geocast service
  • Use content in any way that misrepresents the property's brand or attributes false statements to the property
  • Use content for any unlawful purpose

This license is personal to you. You may not transfer it. The license ends if you misuse it.

3.1Content you submit to Geocast

If you submit content to Geocast (a rating, a comment, feedback, a photograph, a video, or any other content you upload or post through the service, currently or in the future), the following terms apply.

You retain ownership. You retain all rights you have in the content you submit. Geocast does not claim ownership over your submissions.

You grant Geocast a license to use your content. When you submit content, you grant Geocast a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify (for technical purposes such as resizing or format conversion), display, perform, distribute, and create derivative works from the content, solely for the purpose of operating, improving, and providing the Geocast service. This license includes the right to share your content with the property where you submitted it (so the property can see your rating, your feedback, or your photo) and the right to retain your content in backup and archival systems for a reasonable period after you delete it.

You represent that you have the right to grant this license. By submitting content, you represent and warrant that you own the content or have permission from the rights holder to submit it, that the content does not infringe any third party's rights, and that the content does not violate any law.

Geocast may remove content. Geocast may remove or restrict access to any submitted content at any time, with or without notice, for any reason, including violation of these Terms, alleged infringement of third-party rights, response to legal process, or technical reasons.

Limitation on submissions. The current Geocast guest experience accepts limited types of content from guests (ratings, feedback, support correspondence). If future product features expand the types of content guests can submit, this section continues to apply to all such submissions.

3.2DMCA and copyright complaints

Geocast respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe content available through the Geocast service infringes your copyright, you may submit a takedown notice to Geocast's designated DMCA agent.

To submit a takedown notice, send a written communication to Geocast's DMCA agent that includes:

  1. A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright that has allegedly been infringed
  2. Identification of the copyrighted work claimed to have been infringed
  3. Identification of the material claimed to be infringing, with information reasonably sufficient to permit Geocast to locate the material (such as the URL or location within the service)
  4. Your contact information (address, telephone number, email address)
  5. A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or law
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner

Counter-notification. If you believe content of yours was removed from the service in error, you may submit a counter-notification following the procedures set out in 17 U.S.C. § 512(g).

Repeat infringers. Geocast terminates accounts of users who are repeat infringers in appropriate circumstances.

§ 04

Location and proximity features

Geocast uses location features to deliver the right story at the right place. Specifically:

  • GPS location is used to determine when you are near outdoor stories
  • Bluetooth proximity beacons are used inside properties to detect when you are near indoor stories
  • Beacon detection happens on your device. The property and Geocast learn that you played a story, not that you stood in a hallway for ten minutes. Your continuous location is not transmitted

In the mobile web experience, location is used only while the experience is open in your browser.

In the native app, location may be used in the background to deliver proximity-aware moments while you move through a property. Background location is property-scoped: the app activates near a Geocast property and goes dormant when you leave. You can disable location features at any time in your device settings or in the app's privacy controls.

4.1Safe use of the service

Geocast uses GPS, Bluetooth proximity, and push notifications to deliver location-aware story moments. The service is meant to be used while you walk through a property at a comfortable pace, with your attention on the place around you. It is not safe to use under conditions where your attention belongs elsewhere.

Do not use the Geocast service while:

  • Driving or operating a vehicle of any kind
  • Operating heavy machinery, equipment, or tools that require your full attention
  • Cycling, skating, skiing, or otherwise moving at speed
  • Walking on or near roadways, train tracks, construction zones, or other traffic hazards
  • Navigating cliffs, water hazards, steep terrain, or any other location where misstep could cause injury
  • Engaging in any other activity where divided attention could cause harm to you or others

Pay attention to your surroundings. Even while walking through a property at normal pace, look up from your device frequently. The service is designed to be experienced with your attention primarily on the place itself; the audio narration and notifications are meant to enhance, not replace, your awareness of where you are.

Follow property rules and posted signage. Properties may mark certain areas as off-limits, dangerous, or restricted. Always follow posted signage and property staff instructions, regardless of what content the Geocast experience surfaces. If a Geocast story or Hidden Card seems to direct you somewhere a property has marked off-limits, the property's instruction prevails.

Use your own judgment. AI-generated content may suggest locations, paths, or activities. You are responsible for assessing whether any suggested location or activity is safe for you, given the conditions, your physical capabilities, the weather, and other factors that the service cannot evaluate from your device. Geocast is not your guide to physical safety; you are.

If you believe a story or Hidden Card directs guests toward an unsafe area or activity, please contact the property directly and email Geocast at legal@geocast.ai so we can review the content with the property.

§ 05

Content accuracy and the role of the property

Stories, facts, and narratives in the Geocast guest experience are published by the property, not by Geocast. The property is the publisher of the content you experience at that property, the same way a museum is the publisher of its exhibit text.

Geocast provides the production tools the property uses to create and curate content, including AI tools that draft stories and narratives based on the property's own research. The property reviews and approves what gets published.

If you find an error, inaccuracy, or content that concerns you, contact the property directly. Geocast does not pre-approve, fact-check, or guarantee the accuracy of content published by properties.

Some content (ghost stories, local legends, oral tradition) is folkloric by nature and is presented as such. The Geocast service flags speculative or folkloric content where it is published.

§ 06

Acceptable use

You agree to use the Geocast guest experience respectfully. You will not:

  • Use the service to harass, threaten, or harm any person
  • Attempt to circumvent access controls, age gates, or content restrictions
  • Try to access content that has been marked private (such as wedding experiences, staff content, or other gated experiences) without proper authorization
  • Use the service in a way that disrupts or interferes with other guests' experiences
  • Use the service to violate any law
  • Use the service while driving, operating machinery, or under any other circumstances described in Section 4.1

If we determine that you are misusing the service, we may restrict or terminate your access. For most guests this never comes up.

§ 07

AI-generated content

Some content you experience through Geocast is generated by AI tools that draft stories and narratives based on the property's research. AI-generated content can contain errors, including factual inaccuracies. Treat content the way you would treat content in any travel guide, museum panel, or local history book: as a thoughtful telling, not an absolute reference.

The property is responsible for reviewing and approving what gets published. Geocast does not warrant the accuracy of any content. If you find an error, contact the property.

7.1Physical safety and AI-generated content

AI-generated content may describe locations, suggest paths, recommend activities, or surface Hidden Cards keyed to specific places at the property. You are responsible for assessing the safety of any place you go and any activity you undertake based on Geocast content. This responsibility cannot be transferred to Geocast.

Geocast does not inspect properties, does not assess physical safety conditions, and does not guarantee that any place referenced in a story, Hidden Card, or notification is safe to visit, safe to enter, or safe under the conditions you encounter. Conditions change. Weather, time of day, season, your physical capabilities, the presence of other people, and many other factors that Geocast cannot evaluate may make a location unsafe even if it appears in the experience.

Geocast disclaims all liability for physical injury or property damage that may result from your use of the service, including injury or damage caused by:

  • Following the directions, suggestions, or recommendations in any AI-generated story, Hidden Card, narration, or notification
  • Visiting any location referenced in the service
  • Engaging in any activity suggested or referenced in the service
  • Distraction from your physical surroundings while using the service
  • Reliance on the service in lieu of your own judgment about safety

The property where you use the service is responsible for the safety of its premises under applicable premises liability law. If you are injured at a property, your remedy is with the property, not with Geocast.

This section is in addition to the disclaimers and limitations in Sections 9 and 10.

§ 08

Intellectual property

All Geocast trademarks, logos, taglines (including "GEOCAST," "GEOCAST.AI," and "The Invisible Host"), brand designs, app interfaces, and underlying software are the exclusive property of Geocast AI, Inc. Property-specific trademarks, brand assets, and content remain the property of the respective property operator.

Nothing in these Terms transfers ownership of any intellectual property to you. Your license is the limited personal-use license described in Section 3.

§ 09

Disclaimers

In jurisdictions that do not allow the exclusion of certain warranties, some of these disclaimers may not apply to you, and you may have additional rights under local law.

§ 10

Limitation of liability

This limitation reflects the fact that the Geocast guest experience is provided to you free of charge as a feature of the property's hospitality. Specific liabilities of the property to you are governed by the property's own terms, not by these Terms.

In jurisdictions that do not allow the limitation of certain damages, some of these limitations may not apply to you, and you may have additional rights under local law.

§ 11

Dispute resolution

This section affects how disputes between you and Geocast are resolved. Read it carefully.

11.1Talk to us first

If you have a problem, please email guest-support@geocast.ai before starting any formal dispute. We will try to resolve it informally within 30 days. Most things can be handled this way.

11.2Arbitration

If we cannot resolve a dispute informally, you and Geocast agree that any dispute arising out of or relating to these Terms or the Geocast guest experience will be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Consumer Minimum Standards.

The arbitration will be conducted in Deschutes County, Oregon. For any claim seeking less than $10,000 in damages, the arbitration will be conducted on a document-only, virtual basis (written submissions, no in-person hearing, no telephone or video hearing required), unless both parties agree otherwise or the arbitrator determines an oral hearing is necessary in the interests of justice. For claims of $10,000 or more, either party may request a telephone or video hearing.

You will not pay JAMS filing or administrative fees in excess of $200; Geocast will pay all remaining JAMS fees, except as otherwise required by JAMS rules in cases of clearly frivolous claims.

11.3Class action waiver

11.4Carveouts

You can always:

  • Bring a qualifying claim in small-claims court in your home jurisdiction instead of arbitration
  • Seek injunctive or other equitable relief in court to protect intellectual property rights or address urgent harm

11.5Where this section does not apply

If you reside in a jurisdiction where the arbitration agreement, the class action waiver, or any other provision of this Section 11 is unenforceable under local law, those specific provisions do not apply to you. Any dispute will instead be resolved in the courts of your home jurisdiction or as required by local law. The remaining provisions of these Terms continue to apply.

This includes, where applicable, EU consumers, U.K. consumers, Quebec residents, and residents of any other jurisdiction whose consumer protection laws override mandatory arbitration or class waivers.

§ 12

Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles, except where local consumer protection law in your home jurisdiction provides you with rights that cannot be overridden by contract. In that case, those local rights apply.

§ 13

Changes to these Terms

We may update these Terms from time to time. When we do, we will update the version date at the top of this page. Material changes will be communicated through a notice in the Geocast app or guest experience the next time you use it.

If you continue to use the experience after changes take effect, you agree to the updated Terms. If you do not agree, stop using the experience.

§ 14

General

14.1Entire agreement

These Terms, together with the Geocast Privacy Policy, are the complete agreement between you and Geocast regarding your use of the guest experience.

14.2Severability

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect.

14.3No waiver

If we do not enforce a provision of these Terms in one instance, we have not waived our right to enforce it later.

14.4Assignment

You may not transfer your rights under these Terms. Geocast may transfer its rights to a successor or affiliate.

14.5Independent relationships

Geocast is not the property, and the property is not Geocast. Each is responsible for its own services, content, and conduct, except as expressly stated.
